Wyoming DUI Laws & Wyoming DUI Attorneys


Wyoming DUI laws provide two ways in which you could be convicted of a DUI offense. The first is found under the state's "under the influence" laws. If the prosecution in your case can prove that your field sobriety tests, driving pattern, and appearance at the time of your arrest indicated that you were impaired by alcohol or drugs, you can be arrested for DUI. You can also be arrested under the state's "per se" laws. These make it illegal to drive with a blood alcohol content (BAC) of .08% or higher.

DUI Arrests in Wyoming

You will want to get in contact with a DUI attorney as soon as possible after your arrest. You must realize that DUI laws in Wyoming are very strict. You will not be allowed to plea bargain, for example. Because of the tough laws in the state, you need an attorney working with you from the beginning of your case.

You will face two hearings as a result of your DUI arrest. The first is in the criminal courts. This case will determine the extent of your punishments, including whether or not you will have to go to jail. You will also face a hearing in the Wyoming Department of Transportation. This hearing will determine how long your license suspension will be. Again, you will want the help of a qualified attorney for both of these hearings.

Basic Consequences for First Time Offenders

If your Wyoming DUI case is the first you have faced, you can expect to be given these consequences at your criminal court hearing:

First offenders are any offenders with no DUI convictions within the past five years, because Wyoming has a five-year look back period for DUI offenses.

Wyoming has a diversion program known as "Probation Before Sentencing." Under this program, first-time offenders can be put on probation for six months rather than being sentenced by the courts. While on probation, they must take alcohol education classes and undergo treatment. The offender's driving record is cleared if they successfully complete the program. The diversion program is only available one time, even though the driver would be considered a first-time offender if guilty of another DUI after completing the program.

License Suspension for Wyoming DUI

The Wyoming Department of Transportation will suspend your license as a result of your DUI conviction. The minimum license suspension times are as follows:

Wyoming will sometimes offer hardship licenses to those serving licenses suspensions for DUI offenses, but this is rare.

Insurance Consequences

When you have completed your license suspension time, you will need to have car insurance before you can get your license reinstated. You may find, however, that your insurance provider has canceled your policy because of your Wyoming DUI conviction. If this is the case, finding a new provider may be a challenge, because you are now considered a high-risk driver. While finding a new provider is not impossible, you will discover that the cost for your insurance is going to increase dramatically after your drunk driving conviction.
